What Services Can I Expect to Receive?

Maryland Board of Nursing cases can have up to four phases.

Here are the services provided by the firm in each phase:

Investigation Phase

  • Interview the client.
  • Draft and file a letter of representation with the Board.
  • Discuss the legal implications of the case with the client.
  • Draft and file the written response to the complaint.
  • Communicate with the investigator regarding the case.
  • Arrange for the investigatory interview.
  • Meet with the client to prepare for the investigatory interview.
  • Attend the investigatory interview with the client.
  • Attend any preliminary settlement conferences and attempt to negotiate settlement.

Case Resolution Conference Phase

  • Review and analyze the charging document.
  • Obtain, review, and analyze the Board case file.
  • Communicate with the Board regarding the case resolution conference.
  • Meet with the client to prepare for the case resolution conference.
  • Prepare for the case resolution conference.
  • Research any significant legal issues relating to the case.
  • Communicate with the prosecutor regarding settlement options.
  • Attend the case resolution conference and attempt to negotiate a settlement.
  • Review and analyze any proposed order/settlement offer.
  • Arrange for the filing of an executed order/settlement offer.
  • Meet with the client to discuss compliance with any order/settlement agreement.

Evidentiary Hearing Phase

  • Review and analyze the State’s evidence.
  • Identify and retain any necessary experts.
  • Prepare and file expert reports.
  • Prepare and file exhibits.
  • Prepare the opening statement.
  • Prepare direct examination for each of the client's witnesses.
  • Prepare cross-examination for each of the State's witnesses.
  • Communicate with the prosecutor regarding the hearing.
  • Prepare and file the expert designation and proffers.
  • Prepare and file the fact witness list and proffers.
  • Conduct any necessary legal research.
  • Draft and file pre-hearing motions.
  • File oppositions to motions filed by the State.
  • Meet with the client to prepare for the hearing and to testify.
  • Meet with each of the client’s witnesses to prepare to testify.
  • Coordinate the appearance of witnesses at the hearing.
  • Prepare closing arguments.
  • Attend the evidentiary hearing.

Appeal & Judicial Review Phase

  • File the petition for judicial review.
  • Conduct legal research on the issues.
  • Draft a memorandum of law to appeal the Board's decision.
  • Oppose the State's memorandum of law.
  • Attend a hearing before the judge to advocate for the client's appeal.
