What is a Pre-Charge Case Resolution Conference?

A Pre-Charge Case Resolution Conference is an attempt to settle your board complaint without the need for a full investigation or an evidentiary hearing (i.e. a trial before the board). The conference is not a hearing. You do not testify, call witnesses, or introduce documents.

At the conference, you speak with select board members about the complaint that was filed against you. The board members then make a recommendation to resolve your case. The recommendation can be dismissal, discipline against your license, and/or a significant fine. Some cases get dismissed, but the majority of cases do not.

If you disagree with the recommendation made by the board members at the conference, you can reject the recommendation. The case is then referred to an investigator to collect more information, or to Office of the Attorney General for administrative prosecution.

You do have the right to an attorney and you should have one present. An experienced attorney can advocate for you during the conference.

The conference can result in permanent discipline to your license. For example, your license can be reprimanded, put on probation, suspended, or revoked. You can also be fined.

What Happens at a Pre-Charge Case Resolution Conference?

During the pre-charge case resolution conference, you meet with select board members, the attorney for the board, and other board staff.

The board members will review the complaint that was filed against you. They will also review any evidence submitted against you. You will then have the opportunity to address the complaint and propose an outcome to your case.

The board members will then propose a settlement recommendation to you. In many cases, the settlement offer is some type of permanent disciplinary action against your license, or a fine. You have the option of accepting or rejecting the settlement offer.

Effects of Discipline

A Pre-Charge Case Resolution Conference can result in permanent discipline against your license.

The pre-charge case resolution conference is held because someone filed a board complaint against you, or the board has information that you may be in violation of the Practice Act.

Board members can, and often do, trust the information contained in the complaint. The complaint itself, and any documents submitted with it, are evidence that can be used against you to justify discipline and/or a fine.
