What is a Summary Suspension?

A "summary suspension" is an immediate suspension of your professional license and ability to practice as a healthcare provider. It is different than a suspension of your license that can result from an evidentiary hearing.

With a summary suspension, your licensing board will conduct a show cause hearing to determine whether your license should be summarily suspended. If your license is summarily suspended, you must immediately stop working as a healthcare provider.

What Happens at a Summary Suspension Hearing?

A licensing board conducts a summary suspension hearing when necessary. On one side is the healthcare provider (and his or her attorney), and on the other side is a prosecutor from the Maryland Office of the Attorney General.  Yes, a prosecutor is present at a summary suspension hearing to oppose you.

The prosecutor seeks to have your license summarily suspended, and you try to prevent the summary suspension. The board listens to each side and determines whether a summary suspension is warranted by law.

Effects of a Summary Suspension

If your professional license is summarily suspended, you must immediately stop practicing. You cannot use your license while it is summarily suspended. You may also be reported to a national database which could affect your ability to participate in federal programs such as Medicare or Medicaid.

Your license will remain summarily suspended until the suspension is lifted and terminated. A summary suspension can last months, or even years, if not challenged.
